Wendy and Eddie Osefo’s insurance fraud case has hit what The U.S. Sun is calling a major roadblock, three months before their January trial. According to the outlet’s insider, Eddie’s attorney, Joe Murtha, is joining the Carroll County State’s Attorney’s Office in January under the incoming state’s attorney, the same office prosecuting the Real Housewives of Potomac couple. I broke it down in a new video, and I’ll tell you up front: I’m a little concerned, but I’m not panicking. He cannot walk across the aisle and prosecute his own client. Let’s get to this.

He’s Joining the Office, Not the Case

Here’s the thing. You’re going to see headlines saying the Osefos lost their lawyer to the prosecution, and people who aren’t versed in this are going to make assumptions that are wrong. Murtha is going to work for the office. That does not mean he’s on the other side of the aisle at the Osefos’ trial. There’s attorney-client privilege, there’s a conflict of interest, and there’s all kinds of paperwork both he and Eddie signed when he took the case. He can’t share their information or their strategy, and he has to recuse himself completely. He better not even be in the courtroom. Before I said anything, I checked with Teria Faison, who’s been boots on the ground covering these hearings, to make sure this wasn’t the attorney she’d spoken to. She confirmed this is specifically Eddie’s attorney. Remember, we found out on the premiere that Wendy and Eddie had separate legal teams, even though they’ll be tried together. Teria also told me the incoming state’s attorney said during his campaign that he planned to bring Murtha in, so this has been looming. I’m sure the Osefos got a heads-up months ago.

“I’m trying to get the total to exceed $423,000, which is our policy maximum.”

Still, Losing Joe Murtha Is a Loss

That said, losing your best resource three months out is not nothing. Murtha’s resume includes representing Linda Tripp, who was accused of breaking the law when she taped her conversations with Monica Lewinsky. Those charges were dropped in 2000. Eddie hired this man specifically, and that tells me he wanted him because he’s good. And clearly the incoming state’s attorney wanted him for the same reason. He’s worked both sides, prosecution and defense, and that’s what makes him top tier. I’m not saying the rest of his firm isn’t equipped. They’ve probably been on this case the whole time and could be just as good, if not better. I don’t know who they are, I don’t know their caseload, and I’ve never seen them in court. But can they deliver at jury selection and at trial the way he could? We’ll find out. Why leave? This is my assumption, not fact: it’s an opportunity. It’s probably not the money, because the defense side pays better on a case like this. Somebody in my chat suggested political aspirations, and I hadn’t even thought of that. I ain’t mad.

Fifteen Items Is Not Misplacing a Couple of Things

The U.S. Sun also walked back through what the state says happened, and the Osefos haven’t had their day in court, so these are allegations. Prosecutors say they reported a break-in at their Maryland home on April 7, 2024, while they were in Jamaica with their three kids, then filed claims with three insurance companies for designer bags and jewelry. The documents accuse Eddie of filing overlapping claims for the same items with two providers and not disclosing the other policies, and say the sworn statement of loss was $2,500 for the building and an estimated $450,000 in contents. They say investigators spotted Wendy’s diamond anniversary band on her Instagram weeks later, and that in an April 12, 2024 email, Eddie asked Wendy whether there were more high-value items they could add, which is the line you read above. When deputies served a search warrant, they allegedly found at least 15 items reported stolen, including that band, according to the sheriff. Both face charges including conspiracy and insurance fraud, Wendy has an additional false statement charge, and each posted $50,000 bail.

It Might Come Down to Jury Selection

The trial is set for a joint jury on January 25. Somebody in the chat said it will be up to the jury, unless a plea deal comes along, and that’s very possible. We saw that with Jen Shah, when a plea came at the last hour. If it does go to trial, I told Teria the part I’m watching is jury selection, because both sides are going to work hard to get the jury they want. Shout out to Kirsten, who came on the channel during the Diddy trial and broke that process down in layman’s terms. Miss Esquire also called in during Monday’s RHOP recap and said she thought the earlier push for separate trials was about putting pressure on the prosecution, since trying two defendants twice is expensive. Meanwhile, Wendy posted a confessional photo captioned “Still Dr. Wendy,” and she looks great. I really wonder whether this goes to trial at all, and I’m sure they’re wondering too. Does losing Murtha change anything for you, or is it just noise? Let me know. Here we go.
